BSVV successfully defends construction permits for real estate project located in Santiago

The dispute was centered on urban aspects related to the permitted granted for the development and construction of a real estate project. A group of neighbors filed a complaint with the Urban Authorities (Sermi Minvu) claiming the permit had been granted in breach of urban regulations. The process led to a consultation with the Urban Development Directorate, which ruling was consistent with the project developers arguments, and resulted in a favorable decision by the Urban Authorities.

The neighbors also filed two constitutional complaints, which were finally dismissed by the Supreme Court.

BSVV represented the interests of the real estate company owner of the project.

A two-year dispute ended after the Supreme Court dismissed two constitutional complaints filed by residents of the Ñuñoa district of Santiago. This marks the third victory on behalf of the project, in a legal battle fought before the Urban Authorities (Sermi Minvu), the Urban Development Directorate and the Courts of Justice.
